The Massachusetts Legislature enacted M.G.L. c. 93H governing security breaches in 2007, following closely on the heels of a major security breach involving personal identification information of customers of the TJX Companies.  Chapter 93H empowered the Department of Consumer Affairs and Business Regulation (“OCABR”) to implement regulations governing the obligations of Massachusetts businesses to safeguard personal information of Massachusetts residents.

Sense vs. Cents
The Answer that Feels Right May not Always be Right

Even under normal economic conditions, smart restaurant operators and retailers act as though every dollar may be the difference between staying afloat or going under, between profitability and a net-loss. This approach intensifies when the economy constricts, the marketplace shrinks and once plentiful consumer dollars become few and far between. Long-term strategic considerations that make “sense” give way to short-term solutions designed only to preserve “cents.”  Such a myopic business model can result in lost opportunities which otherwise could produce sustained economic benefits.
